It's an older communication that dates back to when I was asking about what happened to Mark McMillan and why, I only vaguely remembered it however and it was just luck I ran across it.Tom,
Keep in mind that prior to SB 742, there were 7 Commissioners. SB 742 increased the number to 9, with the Governor now having the majority with 5 appointees. Part of the agreement for having Governor majority, was that the Governor appointees would have to be confirmed by the Senate. In the past, Governor appointees whose terms expired were allowed to continue serving at the pleasure of the Governor until they either were replaced or reappointed. However, Senate approval of boards and commissions comes with its own set of laws. Per statute, now when a Governor appointee’s term expires, the member may continue to serve a grace period of 60 days until reappointed or replaced. If the member is not reappointed within the 60 day period, the seat becomes vacant and the member may not serve on that board for 365 days. Remember, this applies only to Senate confirmable boards and commissions. Once a member has been appointed to a Senate confirmable board or commission, and has taken their oath of office, the Senate has 365 days to call that new member before the Senate Rules Committee for their confirmation hearing. The Senate usually waits until closer to the one year mark before they call the member for hearing which allows the member to learn the ropes and prove themselves as a valuable member– so to speak. Some board statues don’t require the member to appear before the Rules Committee and are confirmed by consent. If the member passes in the Rules Committee, their name goes to vote on the Senate floor. If not confirmed by the 365th day, the seat becomes vacant. To date, those appointed to the OHMVR Commission have to answer an extensive list of questions from the President of the Senate Rules, but they have not had to appear in person.
