Adam, I need a sweet open faced helmet. My buddies parents bought a polaris crew for the havasu house and we have talked about it for years about how hurt we have been from the golf cart now we have more power so we are all making rad helmets for shenanigans in the polaris. Mine will be outfitted with beer holsters and hoses must have bubble or old skool moto goggles as well. What can you do?

needs to be like a legit helmet. Im not ruling out the possibility of us rolling the polaris or falling out of the thing piss drunk i have fallin out of a rhino wearing nothing but board shorts on to asphalt and last time we were there another friend fell off the golf cart and ended up in needles ER getting 10 staples haha

It is LEGAL to wear a "novelty helmet" -- but you may get a ticket.

California Vehicle Code 27803. (a) A driver and any passenger shall wear a safety helmet meeting requirements established pursuant to Section 27802 . . .

California Vehicle Code 27802. (a) The department may adopt reasonable regulations establishing specifications and standards for safety helmets offered for sale, or sold, for use by drivers and passengers of motorcycles and motorized bicycles as it determines are necessary for the safety of those drivers and passengers. The regulations shall include, but are not limited to, the requirements imposed by Federal Motor Vehicle Safety Standard No. 218 (49 C.F.R. Sec. 571.218) and may include compliance with that federal standard by incorporation of its requirements by reference. . . .

So, what requirements has the CHP established pursuant to Section 27802?

Looking on the CHP site using their search, I find a single page containing "27802". It says:

"In January 1992, California’s mandatory helmet law (California Vehicle Code Section 27803) became effective. The law requires the driver and any passenger to wear a safety helmet meeting Federal Motor Vehicle Safety Standards No. 218 when riding on a motorcycle."

As you can see, above, that is NOT what the LAW, passed by the Legislature and signed by the Govennor says. It says that the CHP "MAY adopt reasonable regulations establishing specifications and standards... The regulations shall include, but are not limited to, the requirements..." The LAW does *not* say you are to wear a helmet meeting Federal Motor Vehicle Safety Standards No. 218.

The pdf also has a pictured labled "One of many non-DOT approved helmets on the road in California" implying that there is such a thing as a DOT-approved helmet. There is not. The U.S. Department of Transportation does not approve or disapprove any helmets. DOT sets the standards, the manufacturers certify that they meet the standards by affixing a DOT sticker.

Bottom line, there is no such thing as a legal helmet. Enforcement of the helmet law is illegal, has been stated so by the courts, but the CHP doesn't care and continues to ticket those wearing "novelty" helmets as being in violation of 27803 even though it is not possible to find a helmet pursuant to Section 27802 as the CHP has never adopted any regulations in accordance with 27802.

Thus, it is LEGAL to wear a "novelty helmet" -- but the CHP doesn't care may ticket you anyhow.

Thats great and all... but you must of missed the part where he wants something that will actually protect him, not just contain the mushy remains. LOL
